Swift to Cunningham & anor. Reg. 27 June 1899 at 30 min. aft. 11 o'c. To the Registrar appointed for Registering Deeds, Wills and soforth in Ireland. A Memorial of an Indenture made the twenty first day of June one thousand eight hundred and ninety nine between Martin C. Swift of Drumbaune in the County of Galway farmer of the first part, Walter Cunningham of Slevefin in the County of Galway farmer of the second part, Patrick J. Cunningham of Slievefin son of said Walter Cunningham of the third part, and Mary Swift of Drumbaune aforesaid sister of said Martin C. Swift spinster of the fourth part.
Whereby after reciting an Indenture of fee farm grant dated 29th September 1809 made between Richard Kerwin therein described of first part, the Trustees and Commissioners of First Fruits payable out of Ecclesiastical Benefices in Ireland of the second part and the Reverend Richard Marley Vicar of the Parish of Annaghdown in the County of Galway of the third part. And that the lands granted by said Indenture were vested in the said Representative Church Body and that by an order of the Commissioners of Church Temporalities in Ireland dated 10th July 1876 the lands granted by said Indenture then vested in the said Commissioners should rest in the said Representative Church Body.And reciting an Indenture of 1st September 1897 and made between the Representative Church Body in Ireland incorporate under the name of the Representative Church Body and said Martin Swift and the last will of Honoria Swift dated 2nd August 1894 and Probate of same to her executor Martin C. Swift, and that a marriage was intended to be solemnized between said Patrick J. Cunningham and said Mary Swift.
And further reciting as therein the said Indenture of which this is a memorial it was witnessed that for the considerations therein mentioned and covenant and conditions then contained the said Martin C. Swift as beneficial owner thereby granted and assigned unto the said Patrick Cunningham and Mary Swift their heirs and assigns absolutely all that and those part of the lands of Drumbaune containing twenty acres more or less the premises conveyed by the thereinbefore partly recited Indentures and more particularly delineated on the said Indenture of 29th September 1809 together with the residence and out offices erected thereon which said lands hereditaments and premises are situate lying and being in the Parish of Annaghdown, Barony of Clare and County of Galway subject as therein mentioned which said deed contained a covenant that the said Mary Swift should make no further claim on the said Martin C. Swift for monies or otherwise received by the said Martin swift as executor of the will of Honoria Swift deceased and also a covenant by the said Martin Swift to hand over to said Patrick J. Cunningham and Mary Swift on the solemnization of said marriage all the farm implements machinery growing crops and hay on said land and one half the household furniture and household effects thereon Drumbaune House aforesaid and also a covenant by Patrick Cunningham and Mary Swift to pay rents and other outgoings which said deed and this memorial as to the execution whereof by the said Martin C. Swift is witnessed by John C. Conroy of Galway in the County of Galway Solicitor and Matt Madden of Galway in the County of Galway Law Clerk and which said Deed as to the execution thereof by the said Walter Cunningham was witnessed by John Conroy of Galway in the County of Galway Solicitor and Matt Madden of Galway in the County of Galway Law Clerk and as to the execution thereof by the said Patrick J. Cunningham by John C. Conroy of Galway in the County of Galway Solicitor and Matt Madden of Galway in the County of Galway Law Clerk and as to its execution by Mary Swift by John Conroy of Galway in the County of Galway Solicitor and Matt Madden of Galway in the County of Galway Law Clerk.
Martin C. Swift (Seal) Signed and sealed by the said Martin C. Swift in presence of John C. Conroy Solicitor Galway Matt J Madden Law Clerk Co Galway. The within named Matt Madden make oath and say that the Deed of which the foregoing is a memoral and the said memorial respectively duly executed by the above named Martin C. Swift say the name Matt Madden subscribed as a witness to said Deed and memoral is my proper name and handwriting Matt J. Madden. Sworn before me at Galway in the County of Galway this 24th day of June 1898 and I know deponent M. Clayton Commissioner for Oaths and Affidavits under the High Court of Judicature (Ireland).
